Centro Nacional de Tecnología y Seguridad Alimentaria (CNTA), Tax ID (C.I.F.) G31096928, with registered office at Ctra. NA-134, km 53, 31570 San Adrián (Navarra), is the promoter of the project www.mundosabor.es, which hosts the Mundo Sabor Community (hereinafter, Mundo Sabor), a web 2.0 platform created to encourage consumer participation around topics related to the food chain.

GENERAL TERMS AND CONDITIONS

ARTICLE 1. MEMBERSHIP CONDITIONS FOR MUNDO SABOR

By accessing www.mundosabor.es, the participant accepts and agrees to abide by these General Terms issued by CNTA, which may be amended at any time.

We therefore recommend checking the latest version regularly; it will always be available on the website.

Without exception, once the participant joins Mundo Sabor by clicking the registration button, they will be deemed to have accepted these General Terms in advance. Their purpose is to define the terms under which the participant may benefit from the service.

Joining Mundo Sabor and actively participating on www.mundosabor.es is subject to adherence to these Terms and Conditions.

The participant acknowledges having read and unreservedly accepted them.

Participation is free of charge and open only to persons aged 18 or over, resident in Spain, and duly registered.

Provided this condition is met, several members of the same household may join.

Membership requires receipt of the completed online registration questionnaire, which includes the personal data requested and brief preference forms needed to create working groups.

Only one participant per registration will be considered valid.

Any doubt, suspicion, or confirmation of fraud, deception, or similar acts shall be sufficient cause for the automatic cancellation of membership, without any right to claim and without prejudice to any legal action that may be brought.

ARTICLE 2. ACCEPTANCE OF THE TERMS AND CONDITIONS

This agreement takes effect on the date on which the Mundo Sabor administrators receive and validate the participant’s duly completed application/registration form. From that date, unless stated otherwise, the participant will be registered for an indefinite period.

ARTICLE 3. PARTICIPANT ACCOUNT

When connecting to the site, participants freely choose a username and password. Both are strictly personal and non-transferable; participants are responsible for keeping them confidential. An interface on www.mundosabor.es allows users to change their password and other details.

If a participant forgets their password, an email procedure is available, provided the username and email address were supplied at registration or later updated.

ARTICLE 4. PERSONAL DATA PROCESSING

In compliance with Organic Law 15/1999 of 13 December on the Protection of Personal Data, participants are informed that their personal data will be incorporated into an automated file under CNTA’s responsibility, for the purpose of managing Mundo Sabor and sending commercial information about our products and/or services that may be of interest, via email, SMS, or any other means. This information will also be used to deliver rewards to participants, share useful information, run promotional actions, etc., and will be kept for as long as necessary and to comply with applicable tax regulations.

Mundo Sabor undertakes to ensure Information Protection and Confidentiality, preserving each participant’s anonymity. Under no circumstances will Mundo Sabor disclose personal data (email, postal address, income level, marital status, etc.) to third parties in any way without the participant’s explicit consent.

CNTA may publish the names of prize winners, as well as the winner’s image, on www.mundosabor.es and/or any other medium.

Data subjects may exercise their rights of access, rectification, and cancellation by sending a letter or email to the following address: Ctra. NA-134, km 53, 31570 San Adrián (Navarra).

ARTICLE 5. EMAIL ADDRESS

During registration, participants must provide a permanent email address for contact purposes. The address can be changed at any time via the site interface. The last email address declared by the participant will be used by the Mundo Sabor administrators to invite them to online or in-person surveys (if they have agreed to take part in Mundo Sabor’s survey program), to respond to questionnaires, or to notify them of service updates.

Participants are responsible for keeping their email address up to date. Mundo Sabor accepts no liability for non-receipt of emails due to incorrect addresses.

Forgetting to update the address or transmission problems related to an inadequate address cannot be invoked as justification for repeated failures to respond to online questionnaires.

ARTICLE 6. PARTICIPANT OBLIGATIONS

Participants undertake to respond sincerely and objectively to the surveys, questionnaires, opinion polls, and tests sent by Mundo Sabor.

They guarantee a single registration within the Mundo Sabor panel community; multiple registrations via the website violate these Terms and will lead to termination.

If the participant agrees to take part in online surveys, they will be informed of available surveys, polls, or tests by email and/or when accessing their account.

No other form of communication will be used. Participants must respond before the deadline; responses received after the deadline will not be considered.

In certain cases, Mundo Sabor may request a response within a short timeframe;

such studies will be clearly identified with a closing date in the email request.

Participants undertake to update relevant personal information in their profile (age, marital status, type of job, income level, etc.) via the site interface, as well as any significant change (e.g., marriage, career changes, birth of a child, etc.).

Updating is mandatory, and Mundo Sabor reserves the right to verify that it has been carried out; this information (in accordance with current legislation) is used to send as many relevant studies as possible.

The questionnaires, surveys, tests and all multimedia materials sent to participants are the exclusive property of Mundo Sabor. Participants therefore undertake not to reproduce, distribute, or share them with third parties for any reason, whether free of charge or for payment.

ARTICLE 7. RESPECT FOR PERSONAL AND PROPERTY RIGHTS

Participants agree to comply with all applicable laws when using the blog/forum, posting opinions on the Mundo Sabor website, in open communication spaces on social networks, and in any other space or medium linked to Mundo Sabor. They further agree not to disseminate messages or information that:

ARTICLE 8. EMAIL

Participants shall not obtain email addresses of other Mundo Sabor participants or third parties with the intention of launching mail bombing, flaming, spamming, or any other action that disrupts the normal operation of another participant’s email.

They shall not encourage visiting websites that violate applicable laws or the rights mentioned above.

ARTICLE 9. MUNDO SABOR POINTS SYSTEM & REWARDS

Mundo Sabor Points

In exchange for sincere and active participation in each questionnaire, survey, or test for the Mundo Sabor Panel, participants will accumulate non-transferable points that can be redeemed for rewards. Points credited to a participant’s account are valid for 24 months; if they are not used within that period, they will be automatically deleted.

Mundo Sabor points are a virtual currency awarded to registered, active members as a reward for their participation in initiatives and studies promoted by Mundo Sabor.

For each survey correctly completed in full and submitted within the deadline, the specified points for that survey will be credited.

Participants will accumulate points that can be redeemed via their account, based on a virtual rewards catalog available on www.mundosabor.es.

If Mundo Sabor definitively ceases activity, this agreement will terminate and the points system will be cancelled, with no obligation to honor redemptions and no liability for the promoter.

Mundo Sabor reserves the right to offer a substitute reward of equivalent value to the originally offered prize, and to change the number of points awarded for responding to surveys, participating in studies, or taking part in site activities.

No cash alternative is available for rewards.

Rewards

The organization reserves the right to replace rewards with similar items of equal value. Rewards cannot be combined with other promotions and are not exchangeable for other services or their cash equivalent.

Rewards are personal and non-transferable.

Where a reward is to be enjoyed by two people, it must be redeemed by the winner together with the person they designate. All rewards are subject to availability.

Travel expenses to the place where the stay takes place will be borne by the customer; CNTA accepts no responsibility for any incidents arising from such travel.

Rewards include only the services specified and exclude any additional expenses incurred during the trip, which are the winner’s responsibility.

If a reward is out of stock and/or discontinued by the supplier, participants will be informed with an indicative delivery date for the goods, or—if the issue cannot be resolved—offered an alternative product of similar value.

Reward management

Once the number of points required in the Mundo Sabor catalog has been reached, the user may request redemption through the interface in their account. To receive the reward, the user is responsible for verifying and keeping their personal details (name, surname, address, etc.) up to date.

After verifying that all requirements are met, Mundo Sabor will process and send the reward by post, and the redeemed points will be deducted from the account.

Deliveries

If the package is delivered defective or with apparent tampering, the customer must reject the goods upon delivery and notify Mundo Sabor staff as soon as possible.

ARTICLE 10. RIGHT OF CANCELLATION

Mundo Sabor reserves the right to suspend or terminate this agreement at any time in the event of a breach of Article 5 in any form. In such a case, any rewards earned by the participant will be immediately cancelled, without prejudice to claims for damages. Mundo Sabor will regularly check the consistency and quality of participants’ responses to questionnaires, surveys, and tests. If participants provide inaccurate or inconsistent responses, or if suspicious response times are detected, Mundo Sabor may automatically terminate this agreement.

Mundo Sabor also reserves the right to terminate the agreement of any participant who has not answered a single questionnaire for 12 months, assuming that the participant had agreed to take part when invited to join. This termination will result in the cancellation of rewards without any compensation for either party.

If the participant—whether a minor or an adult—wishes to terminate this agreement, they must inform the Mundo Sabor panel coordination department. Termination should preferably be notified by email to comunidad@mundosabor.es. However, any other form of termination may be used; in that case, the participant assumes responsibility for the consequences of termination by postal letter addressed to: Centro Nacional de Tecnología y Seguridad Alimentaria (CNTA), Ctra. NA-134, km 53, 31570 San Adrián (Navarra).

In particular, Mundo Sabor accepts no responsibility for any loss of registration or reward data arising from termination by any method other than a registered letter with acknowledgement of receipt.

The letter or email must include the word “Cancelación” (Cancellation) and clearly specify the ID and password, so that the request can be validated.

Any termination initiated by the participant for reasons other than the impossibility of complying with the clauses contained in this agreement (for reasons expressly specified) will result in account cancellation, without any claim to points by the participant.

ARTICLE 11. ACCESS TO THE SERVICE

The participant shall ensure that the computer and telecommunications equipment required to access the service are properly installed. The participant is responsible for any expenses incurred in their Internet connection. Access to our website is completely free of charge.

Through its IT department, CNTA will make every effort to provide the highest possible level of availability so that the Service can be guaranteed.

On the Internet, however, this guarantee cannot be understood as an absolute assurance of availability and performance.

CNTA shall not be liable for any consequences, damages, or losses that may arise from such access or use of the information. CNTA is not responsible for possible security errors that may occur, nor for potential damage that may be caused to the user’s computer system (hardware and software), files, or documents stored therein, as a result of the presence of viruses in the user’s computer used to connect to the services and contents of the website, malfunction of the browser, or the use of non-updated versions of it.

Therefore, the user expressly and unreservedly accepts that access to and use of the website is carried out under their sole and exclusive responsibility

ARTICLE 12. OWNERSHIP

CNTA is the owner and/or licensee of all the information contained on this website, including its graphic design, images, databases, indexes, source codes, trademarks, and logos, all of which are protected in accordance with the provisions of the Intellectual Property Law and the Trademark Law.

The CNTA firm owns the registered trademark Mundo Sabor.

Any representation and/or reproduction of this website or any of its elements, in whole or in part, as well as the use of any process without the express authorization of CNTA, is strictly prohibited and would constitute piracy sanctioned under the Intellectual Property Code.

The availability and use of the website does not, under any circumstances, imply the transfer of ownership or the granting of a right of use in favor of the user. Therefore, any reproduction, copy, total or partial distribution, or commercialization shall require CNTA’s prior written authorization. CNTA reserves the right, in cases of misuse of the website, to pursue any necessary legal actions to recover damages caused. Likewise, the user undertakes to indemnify the entity for any damages or losses that may arise from the use of this website in violation of these general conditions and/or applicable law.

The participant hereby undertakes to respect the property rights held by CNTA and any third party.

ARTICLE 13. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

CNTA reserves the right to amend these general terms and conditions. Any modification to these Terms and Conditions shall be communicated by Mundo Sabor to the email address provided by the participant. Mundo Sabor cannot be held liable for the non-receipt of any notification email. By continuing to use the website or services, the participant acknowledges and accepts the amended general terms and conditions.

Any use of the service following modifications to the general terms and conditions shall constitute acceptance of the new terms for use of the Service.

The general terms and conditions published online by CNTA on the website shall prevail over any previously printed version.

ARTICLE 14. COMPLETENESS OF THE INFORMATION

  1. These general conditions contain all obligations of the parties.
  2. No general or special conditions contained in documents sent or presented by either party may be incorporated into these terms.
  3. The fact that one of the parties has not acted against a breach by the other party of any of the obligations herein, regardless of its nature, shall not be interpreted as a waiver of the obligation in question for the future.

If one or more provisions of these general conditions become invalid or are declared so by law or regulation issued by a competent court, the remaining provisions shall retain their force and scope, unless the invalid provision(s) are of a substantial nature and their invalidation disrupts the balance of this agreement.

ARTICLE 15. JURISDICTION

Assignment of jurisdiction.

Pursuant to Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, Spanish legislation shall apply to any disputes that may arise.

For the resolution of any dispute or discrepancy that may arise regarding the interpretation or application of these terms, participants expressly submit to the jurisdiction and competence of the Courts and Tribunals of Logroño, expressly waiving any other jurisdiction to which they may be entitled.
